AAP Files Joint Comments on "Orphan Works" Issue
In response to a Notice of Inquiry published by the U.S. Copyright Office, seeking public comments on ways to handle the problem of “orphan works,” (works whose copyright owners cannot be located by third parties seeking permission to use them), AAP joined with the Association of American University Presses (AAUP) and the Software and Information Industry Association (SIIA) in filing comments on March 24.

AAP Applauds Creation of New Anti-Piracy Caucus
AAP issued a statement on October 21 commending the Senate and House members who have joined in creating a new bipartisan caucus that will focus on the growing threat of copyright piracy abroad.

State Sovereign Immunity & Copyright
Book Publishers Seek Restoration of Equitable Treatment Under LawAs the result of a series of controversial 5-4 decisions by the U.S. Supreme Court in 1999, State entities that infringe the rights of intellectual property owners under federal statutory law may now assert a right of sovereign immunity under the Eleventh Amendment to avoid the injured party’s claims for monetary damages in federal court.

Representatives Boucher and Lofgren reintroduce bills in the 108th Congress to amend the Copyright Act
As expected, at the beginning of the 108th Congress in January, Representatives Rick Boucher (D-VA) and Zoe Lofgren (D-CA) each reintroduced their respective proposed legislation from last year to amend the Copyright Act. In fact, Rep. Boucher’s bill, the “Digital Media Consumers’ Rights Act” (H.R.107), was the first technology-related legislation introduced in the new Congress. Both bills are identical to legislation Representatives Boucher and Lofgren introduced in the final weeks of the 107th Congress.
